MICROBIOLOGY VIDEO LIBRARY USER LICENCE AGREEMENT:
Access to the Microbiology Video Library CD is provided on an AS IS basis, without warranty of any kind, including without limitation the warranties that the software is free of defects, merchantable, fit for a particular purpose or non-infringing. The entire risk as to the quality and performance of the software is borne by the Licencee. Should the software prove defective at any time, the Licencee and not the Licensor (A.J. Cann) assumes the entire cost of any service and repair. This disclaimer of warranty constitutes an essential part of this Agreement. No use of the Software without payment of licence fees to Licensor is authorized. This licence confers no rights whatsoever on any person other than the Licensor and Licencee and is not to be enforceable by any other person.
SCOPE OF LICENCE GRANT:
You may:
Download a copy of the Software to your local system;
Access the Software on a disk, Local Area Network (LAN) or Intranet, provided that a licence has been purchased.
You may not:
Permit or enable other individuals to use the Software via any form of public access network (e.g. bulletin board or internet);
Permit or enable other individuals to use the Software except under the terms listed herein;
Modify, translate or create derivative works based on the Software;
Rent, lease, grant a security interest in, or otherwise transfer rights to the Software;
Remove any proprietary notices or labels on the Software.
TITLE:
Title, ownership rights, and intellectual property rights in the Software shall remain in the Licensor. The Software is protected by copyright and other intellectual property laws and by international treaties. Title and related rights in the content accessed through the Software is the 
property of the applicable content owner and is protected by applicable law. The licence granted under this Agreement gives you no rights to such content.
TERMINATION:
This Agreement and the licence granted under it will terminate automatically if you fail to comply with the limitations described here. Upon termination, you must destroy all copies of the Software.
LIMITATION OF LIABILITY:
Under no circumstances and on no legal basis whether tort, contract, or otherwise, shall the Licensor be liable to you or any other person for loss or damage of any character including, without limiting the above, damages for loss of goodwill, work stoppage, loss or corruption of data or software, computer failure or malfunction, or any and all other commercial damages or losses. In no event will the Licensor be liable for any damages in excess of the amount the licensor received from you for a licence to the software, even if the Licensor has been informed of the possibility of such damages, or of a claim by a third party. English Law applies to this Agreement. This Agreement represents the complete agreement concerning the licence granted hereunder and may be amended only by a writing executed by both parties. The Microbiology Video Library is purely a virtual computer exercise. It is not intended for use for any medical, experimental or similar purpose. You should in no circumstances attempt to copy any of the experiments. No responsibility whatsoever is accepted for any loss, damage or injury resulting from any use to which information or ideas from this Software may be put.
